Hurricanes and Health Care Facilities: Holding Florida Nursing Homes and Assisted Living Facilities Accountable
Failure to Follow Physician Orders
Nursing facilities are the eyes and ears of the residents’ respective physicians. They are also responsible for complying with the residents’ physicians’ orders, documenting such compliance, and noting any findings. When a resident’s physician prescribes medication, orders bloodwork, orders diagnostic testing, orders treatment, or discontinues a prior order, it is incumbent upon the nursing facility to timely comply with such orders. When a nursing home fails to document and follow a physician’s order, it can lead to dire outcomes for the resident.
It is important to note that the failure to follow a physician’s order, in and of itself, is not enough to present a nursing home or assisted living facility abuse and neglect case. Instead, the failure must have caused an injury.
